Extradition from Austria of Nail Malyutin, Russian national, accused of embezzlement of 253 million roubles.

The Ministry of Justice of the Republic of Austria has granted extradition of Russian national Nail Malyutin for his prosecution for the crime fallen under Article 159(4) of the Criminal Code of the Russian Federation (fraud committed in especially large amount).

The General Investigative Department of the Investigative Committee of the Russian Federation for the North Caucasian Federal District accuses Malyutin of embezzlement of money funds belonged to Finance Leasing Company (JSC), with state interest, in the amount of 253 million roubles, by means of setting up a sham contract on sale of civil aircrafts.

Since Malyutin absconded he was declared internationally wanted; a measure of restriction in the form of taking into custody was ordered to apply against him. Later he was located in Austria; and on December 25, 2014, the Prosecutor General’s Office of the Russian Federation requested Austrian competent authorities to extradite him.

Upon requests by the Austrian party the Prosecutor General’s Office of the Russian Federation repeatedly provided it with clarifications, as well as additional guarantees of observance of Malyutin’s rights. In December 2015, consultations on the case were held with representatives of the Ministry of Justice of the Republic of Austria.

In March 2016, the Federal Minister of Justice of the Republic of Austria agreed to the previously issued court decisions on granting extradition of Malyutin to Russia.

However, the above decision was also appealed against by Malyutin. On December 7, 2016, the Court passed a final decision.

On January 20, 2017, in Vienna international airport, Malyutin was handed over to representatives of the Russian law-enforcement bodies.
